DECREE

On the National Coordination Committee to fight Acquired Immunodeficiency

Syndrome (AIDS), tuberculosis (TB) and malaria in the Republic of Tajikistan

 

In accordance with Article 12 of the Constitutional Law, Republic of Tajikistan “On the Government of the Republic of Tajikistan” and aiming at preventing the spread of acquired immunodeficiency syndrome (AIDS), tuberculosis (TB) and malaria infections and coordination of the activities of ministries, departments, local executive bodies of state power, religious and public associations, other enterprises and organizations regardless of the form of ownership, the Government of the Republic of Tajikistan made the following decision:

1. To approve the bylaws (Regulation) and composition of the National Coordination Committee to fight AIDS, TB and malaria in the Republic of Tajikistan (attached).

2. The Decree of the Government of the Republic of Tajikistan dated October 4, 2005, No. 381  to be considered not valid

Bylaws on the National Coordination Committee to Fight Acquired Immunodeficiency

Syndrome, Tuberculosis and Malaria in the Republic of Tajikistan

(amended by the Decree of the Government of the Republic of Tajikistan,31 July 2018, No 363)

 

1. General Provisions

1. This Bylaws determines the rights, organization and activities procedures of the National Coordinating Committee to fight acquired immunodeficiency syndrome (AIDS, tuberculosis (TB) and malaria in the Republic of Tajikistan (hereinafter referred to as the National Committee), which is a permanent advisory body in the Republic of Tajikistan.

2. The National Committee was established with the aim to coordinate activities of ministries and departments, local executive bodies of government, international organizations accredited in the Republic of Tajikistan, civil society, religious and non-government organizations for implementation of prevention and epidemic measures to fight acquired immunodeficiency syndrome, tuberculosis and malaria.

3. The National Committee in its activities is guided by the Constitution of the Republic of Tajikistan, the laws of the Republic of Tajikistan, orders and decrees of the President of the Republic of Tajikistan, resolutions of the Government of the Republic of Tajikistan and other regulatory legal documents, as well as the current Bylaws.

2. Main goals and objectives of the National Committee

4. The main goals and objectives of the National Committee:

– coordination of the work of ministries, departments, state, public organizations and enterprises, local executive bodies of state power and international organizations for the prevention and control of acquired immunodeficiency syndrome, tuberculosis and malaria;

– improving the national strategy in connection with the epidemic of acquired immunodeficiency syndrome, tuberculosis and malaria;

– conducting regular monitoring of the implementation of national and strategic programs to prevent and control of acquired immunodeficiency syndrome, tuberculosis and malaria by ministries, departments, local executive bodies of the government of regions, cities and districts of the country;

– ensure interaction between various areas of its activity between governmental, international and non-governmental organizations;

– mobilize financial and technical resources for the effective implementation of programs for the prevention and control of acquired immunodeficiency syndrome, tuberculosis and malaria, including donor assistance;

– recognize the three key principles of the UN in the fight with the epidemic in the activities of the National Committee:

a) a unique agreed policy;

b) a unique national coordination body;

c) a unified coordinated monitoring and evaluation system;

– changing the society’s attitude to the epidemic of acquired immunodeficiency syndrome, tuberculosis and malaria.

5. In accordance with the assigned tasks, the National Committee performs the following activities:

– development of national programs and strategic plans to fight acquired immunodeficiency syndrome, tuberculosis and malaria;

– development of proposals to the Government of the Republic of Tajikistan with amendments and changes to the policy and legal acts of the Republic of Tajikistan on the prevention and control of acquired immunodeficiency syndrome, tuberculosis and malaria;

– organizing epidemiological situation study with the aim to identify the real situation of the epidemic in the country;

– participation in meetings, conferences, other activities of the governmental structures and international and national non-governmental organizations;

– involvement of representatives of organizations and enterprises, specialists and scientists per identified procedures to perform certain activities;

– organize and ensure interactions and coordination of activities by all partners.

3. Rights of the National Committee

6. In order to perform its functions, the National Committee has the right to:

– develop and approve regulations, programs and plans for their work;

– accept and make appropriate recommendations and proposals for further improvement of the implementation of programs and measures to fight epidemics;

– in order to ensure transparency and awareness of activities, request information from governmental, public and international organizations related to control of the diseases;

– coordinate the development and submission of national fund requests to the Global Fund;

– in accordance with the work plan of the Oversight Commission under the National Committee, supervise the utilization of grants from the Global Fund and other investments;

– review reports on the progress of the implementation of grants from the principal recipients of grants from the Global Fund and other entities;

– recommend to the Global Fund to change the principal recipients of grants;

– ensure mutual coordination of activities by all partners;

– in accordance with the goals and objectives create commissions and working groups consisting of the members of the National Committee, employees of state institutions and representatives of organizations and institutions that are non-members of the Committee,. The management of commissions and working groups is entrusted to one of the members of the National Committee.

4. Structure and procedure for the activities of the National Committee

7. The National Committee is headed by the Chairman – Deputy Prime Minister of the Republic of Tajikistan, who leads the meetings of the Committee and approves the agenda.

8. The Deputy Chairman of the National Committee is the Minister of Health and Social Protection of the Population of the Republic of Tajikistan. The Deputy shall act as the Chairman in his absence. The Chairman and his Deputy ensure high political commitment in the implementation of national programs for the control of acquired immunodeficiency syndrome, tuberculosis and malaria, convene and chair regular meetings of the Committee. Approve the decisions taken at the meetings of the National Coordinating Committee and the minutes of the meetings with their signature, guarantee the correctness and transparency of the decision-making process (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018, No. 363 ).

9. Meetings of the National Committee are held at least twice a year. Extraordinary meetings may be convened in the interval between regular meetings with the consent of the Chairman of the Committee and at the suggestion of at least two of its members. Proposals for inclusion in the agenda can be made by any member of the Committee. Any of the submitted proposals is considered at the meeting of the Committee. Decisions made at the meetings of the Committee are considered valid if there is a quorum of more than half of its members and are adopted by a majority vote of the members present (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ).

10. The National Committee consists of 26 members, which includes representatives of government agencies, UN agencies, donors, international organizations, civil sociaty organizations, representatives of people infected with the human immunodeficiency virus / acquired immunodeficiency syndrome, tuberculosis and malaria, representatives of religious organizations (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ).

11. Any institution or person from the aforementioned categories may become a member of the National Committee if it satisfies the following requirements:

– represents the activity registered in the Republic of Tajikistan;

– works in the field of acquired immunodeficiency syndrome, tuberculosis and malaria, and also contributes to the implementation of the national response to the fight against acquired immunodeficiency syndrome, tuberculosis and malaria, the Millennium Development Goals and other initiatives taken in the field of health;

– is a representative of non-government and private organizations, persons infected with acquired immunodeficiency syndrome, tuberculosis and malaria, persons having directly relationship to them, charitable organizations;

– take part in the activities undertaken by the National Coordinating Committee, as well as shares experience and information.

12. Members of the National Committee have the right to:

– participate with the right to vote to make decisions of the National Coordinating Committee;

– submit recommendations for consideration of the National Coordinating Committee;

– obtaining information regarding activities at the coordinating and working level, upon presentation of a request or when, as required;

– Active participation in the activities of the National Committee.

13. Responsibilities of the members of the National Committee are to:

– comply with the requirements of this Regulation, other documents regulating the activities of the National Committee;

– take part in meetings of the National Committee;

– actively participate in meetings and decision-making;

– inform the National Coordinating Committee of their conflict of interest, if any;

– report to their voters, the sector.

14. Criteria for exclusion from the National Committee are as following:

– any organization or member may send a request in writing addressed to the secretariat of the Committee about the desire to be excluded from the National Committee. The decision on exclusion is taken by the Chairman of the Committee, which comes into force on the day of the decision. The Secretariat informs all members of the National Committee about this.

– Absence of a member of the National Committee without a valid reason at two or more consecutive meetings.

15. The National Committee has the right to rotate members of the Committee every three years. The same representative may be elected for a second term no more than 2 times.

5. Secretariat of the National Committee

16. The secretariat is the operating body of the National Committee. The secretariat is headed by an executive secretary, who is approved by the members of the National Committee on the proposal of the Chairman of the National Committee. The Secretariat shall act on the basis of this provision. In order to perform its functions, the secretariat performs the following (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ) :

– acts within its powers, resolves issues in agreement with the chairman of the National Committee (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 );

– coordinates preventive activities aimed at control of the human immunodeficiency virus/acquired immunodeficiency syndrome, tuberculosis and malaria on behalf of the National Committee;

– development of the annual work plan of the National Committee;

– providing information to the Chairman and Deputy Chairman of the Committee (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ) ;

– organize the work of the meetings of the National Committee, informing its members about the date and agenda;

– develop materials to be used at a meeting of the National Committee;

– sharing materials to members of the National Committee;

– Keeping records of meetings of the National Committee;

– collaborate with state, international organizations and national non-government organizations in agreement with the members of the National Committee (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ) ;

– coordinate activities and services related to the issues of acquired immunodeficiency syndrome, tuberculosis and malaria at the national and regional levels;

– organize the work of technical working groups (per amendment to the Decree of the Government of the Republic of Tajikistan dated July 31, 2018 No. 363 ) .
